The Process of Applying for the EB-2 NIW Visa

Step 1: I-140 Petition

You must submit and receive approval for the I-140 Immigrant Petition, which proves that you meet both the EB-2 and NIW eligibility requirements.


Step 2: Filing for a Green Card

Once your I-140 is approved and your priority date is current, you can apply for permanent residency. There are two ways to apply based on where you are currently residing:


Option 1: Adjustment of Status (AOS) – Applying Inside the U.S.

If you are already in the U.S. on a valid visa, you may be eligible for Adjustment of Status (AOS).

  • Unlawful Presence: You must not have overstayed or accrued unlawful presence that bars you from adjusting status.

  • Valid Status: You need to maintain a lawful visa status in the U.S. during the application process.

  • Concurrent Filing: If your priority date is current, you can file your I-140 and I-485 together to streamline the process.


Advantages of AOS:

  • Stay and work legally in the U.S. while your application is processed.

  • Apply for work authorization (EAD) and travel permits (Advance Parole) while waiting for approval.

  • No need to travel abroad for interviews—everything is handled domestically with USCIS.


Potential Limitations:

  • You must maintain lawful status during the process.

  • Traveling without advance parole can result in your application being considered abandoned.


Option 2: Consular Processing – Applying Outside the U.S.

If you are outside the U.S. or ineligible for AOS, you can apply through Consular Processing at a U.S. embassy or consulate in your home country.

How It Works:

  1. I-140 Petition Approval: Your I-140 must be approved and your priority date current.

  2. National Visa Center (NVC) Coordination: The NVC will collect your documents and schedule an interview.

  3. Visa Interview: You attend an interview at the U.S. embassy or consulate.

  4. Enter the U.S. with Permanent Residency: Once approved, you can enter the U.S., and your Green Card will be mailed to your address.

Benefits of Consular Processing:

  • You don’t need to maintain lawful U.S. status.

  • The process can be completed while you remain abroad, minimizing disruptions.

Potential Limitations:

  • Processing times depend on the embassy’s workload, which can be unpredictable.

  • No access to interim benefits like work authorization or travel permits.
